A Tool For People That Mean Business!
A Few Things You Need To Know About "Maximum Practicable Utilization"
Above all, you need to know that "it is the Policy of the United States that small business concerns (hereinafter "SBCs")...Shall have the Maximum Practicable opportunity to participate in the performance of contracts let by any Federal agency, including contracts and subcontracts for subsystems, assemblies, components, and related services for major systems."

Said another way, whenever and in whatever industries SBCs demonstrate that they have the capability and capacity to meet the needs of the Requirements that are being competed by any Federal agency – side requirement, by U.S. Policy, Shall be Set-Aside for competition among and award to SBCs.
This is the desired outcome that Congress set into motion when the words Maximum Practicable Opportunity were included as a part of the Guiding Principles that make up the Small Business Act.
Notwithstanding Any Other Provision of Law, when the above conditions are met, the award of Requirements to Other than SBCs is a violation of the Sprit, Intent and Policy that was set forth under the Small Business Act.
Clearly, there are a few laudable exceptions – like the Policy governing AbilityOne, the Federal Prison System...etc. Yet I digress, as our focus is on the rule or Policy here – not the exceptions.
Be that as it may. For decades, Federal agencies have not complied with the clearly stated Policy of these United States – and you might be asking yourself 'why not'...
The simple answer is because we the Stakeholders (SBCs, Congress and the past-seated Administrations) allowed them to.
We drank the 'Kool-Aid, took the Red-Pill and allowed ourselves to be conditioned to believe – without questioning – whatever our Federal employees and the cottage advising industries the grew-up with them told us.
Simply put, we got sucked into the Federal Matrix – A place where 'Maximum Practicable Opportunity' is redefined as the 23% Goal. Moreover, in the Federal Matrix, Big Hogs got fatter and fatter by feeding on meals that by U.S. Policy are reserved for the true Economic and Jobs Creation Engines of this Great Nation (i.e. SBCs).
Before I proceed, I believe that it is important to state for the record that I am not charging anyone that does not realizes that he or she is caught-up in the Matrix – with any intentional commission of a wrongdoing. What I am doing here is illuminating an educated and right-minded perspective that has the value creation power needed to stabilize and enhance the Jobs Creation foundation of this Great Nation.
So if the glove don't fit...You know what to do...Look at all of the ____ evidence!
Let's take a look at the outcomes that this Matrix Centric mindset has produced:
• A concentration of Federal spending that created a group of 'Too-Big-To-Fail' Enterprises – that are also proving to be too big to manage,
• A weakened Federal Supply Chain structure that can be materially disrupted by the failure or Off-Shoring of one or a few of the aforementioned Enterprises,
• A strong enough disconnection between the cause and effect of one's actions and the outcomes of those actions that some Stakeholders are motivated to actually develop rational arguments that support weakening the Small Business Act,
• The development of belief systems, within the minds of some appointed and elected Stakeholder, that accepts the Idea that the way things are – is the way it has to be, as any attempt at Changing things would be too difficult to achieve, and so on...
I could not disagree with the Matrix Mindset more, and to those who share that mindset I would remind them that we would not have the Free Nation that we enjoy today if our early Patriots did not have a better Believable Dream. A Dream that motivated them to accept the fact that the difficulties of success did not relieve them of the obligation of trying to push those Red Coats back.
Moreover, there is no denying the fact that our forefarthers left our generations with the bold ability to say in one full-throated voice:
We hold these truths to be self-evident, that all SBCs are created by the same Source, and they are endowed by Congress through certain guiding principles, that among these are the acquisition of Prime and Subcontracts — and full participation in Federal spending
That to secure these rights – PL 85-365 & PL 110-28 were instituted among Agencies – deriving their just powers from the consent of the governed.
That whenever any Form of Acquisition becomes destructive of these ends, it is the Right of the People to alter or to abolish them, and to institute new Systems, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect the Maximum Practicable Opportunity for future Generations.
Now it's our turn.
The following numbers reveal both the trend and opportunity that requires the attention of every Stakeholder in this process – including the Citizens that makeup the organizations that we refer to as Other than SBCs or Large Prime Contractors.
Moreover, as the central stabilizing force of our economy, we cannot remain devided on this issue-- as this is not a WOSB, SDVOSB, SDB, HUBZone or SBC only -- issue. What we are dealing with here is an American Issue, and you too can play a vital role in reshaping the Arch of Small Business Contracting Performance.
So, what say Yee – one and all – SHALL we Vote for a stronger economic future by embracing the Wise Policy of our Forefathers? Or, MAY we continue to trust in the reality of the Matrix?
